The High Court of the Federal Capital Territory has dismissed the rape case filed against Pastor Biodun Fatoyinbo by Busola Dakolo. 

 At court sitting in Bwari, Abuja on Thursday. The presiding judge, Justice Oathman A. Musa, dismissed the case against Biodun Fatoyinbo, senior pastor of Commonwealth of Zion Assembly on the ground that the case was aimed more at cruelty than obtaining justice. The judge ruled that the case is empty and purely sentimental.

The court also awarded costs of N1,000,000 against Dakolo and held that the fine should have been 10 times more because the court’s time was wasted.
Recall that Busola, wife of popular musician, Timi Dakolo, had dragged Fatoyinbo before a Federal Territory High Court in Abuja, over allegation of rape.

She told the court that the pastor raped her when she was a teenager. 
According to a press statement she released on June 28, 2019, the incident had caused her continuous emotional distress. 

She told the court that the rape had adversely affected her marital sex life and therefore demanded a letter of apology from Fatoyinbo to show remorse for the alleged action.

 The Executive Senior Assistant to the Senior Pastor of COZA, Areola Adetuberu, in a statement in Abuja after the ruling, said Fatoyinbo was a victim of an organised blackmail. 

He said it was “fuelled by envy and sheer jealousy, as an unnecessary distraction and a fight from the pit of hell.”
